The Eighth Article Papers, VII.


Clause 3: The House of the People shall have the sole Power of Recall of any legislative, executive, judicial, or civil officer, but may only Recall such an officer upon reaching Majority, however the Power of Recall shall not extend further than the removal from Office, and disqualification to hold and enjoy any Office of honor, Trust or Profit under the United States: but the Party convicted shall nevertheless be liable and subject to Indictment, Trial, Judgment and Punishment, according to Law.
The Power to Impeach and remove any member of our Government from their position of privilege is vitally important to protect this Nation against Tyranny. The Fathers of our Constitution were wise in that they laid out the Framework for the Impeachment of any member of the Judicial, Legislative, or Executive Branches, but put significant safeguards in place to prevent this Power from being abused.

However, in the 230 years since the Ratification of the Constitution, only two Presidents have been impeached, and none have been removed from Office. In our long, and at times dire History, only one President would likely have been removed for his actions, and He chose to voluntarily resign. Similarly, no Supreme Court Justice has ever been removed by impeachment as well. On the whole, one could argue the reason why for the later, but certainly not for the former. More often than not, political expediency has prevented such purges, often to the detriment of the People.

Worse, on Election Day the good Citizens of our Republic are often given a choice, it is said, of the lesser of two evils. There currently is no option to cast your Vote for “none of the above”. For this reason, one could safely assume that to guarantee such an option to the People would only have the effect of producing better Candidates, and more dedicated Administers of Government.

This Proposal does just that, to give to the People, the Power to remove any Officer in Government for unsatisfactory behavior in Administering the People’s Trust. This too is based on the Language already in the Constitution. Article. I., Section. 3., Clause 7 states:

“Judgment in Cases of Impeachment shall not extend further than to removal from Office, and disqualification to hold and enjoy any Office of honor, Trust or Profit under the United States: but the Party convicted shall nevertheless be liable and subject to Indictment, Trial, Judgment and Punishment, according to Law.”
